Kate¿s Lawyer Files Contempt Claim

PHILADELPHIA - Kate Gosselin’s lawyers asked a Philadelphia-area judge to consider contempt of court charges against Jon Gosselin.

The action is related to a controversy over Jon Gosselin withdrawing most of the money from couple’s $231,000 money-market account since August.

On Monday, Kate Gosselin said she can’t pay her family’s bills after husband Jon Gosselin emptied the account.

Court records show Kate Gosselin’s lawyers want a contempt charge, special relief and Jon Gosselin to pay all legal fees related to the court filing.

Special relief would be a request for Jon Gosselin to return the funds to the joint account.

Despite some media reports, there is not a hearing scheduled for Monday on the Montgomery County court docket.

Kate Gosselin, 34, confirmed reports on the "Today" show that she has just $1,000 in cash and bills way beyond that to pay.

"It is accurate," Kate Gosselin said.

Directly addressing Jon Gosselin, Kate said: "You left your children and their mother unable to pay the bills."

Reports over the weekend said Jon Gosselin took $230,000 out of the couple's joint bank account. At one time, the account had $231,000.

Jon Gosselin's lawyer, Mark Jay Heller, sent a statement to Entertainment Tonight about the allegations.

"He has not withdrawn any money for his own remuneration with the exception of the past several months wherein he believes he only withdrew approximately $175,000 which is less than ten percent of the gross revenues paid the Gosselins," Heller said.

Heller said that when all the Gosselin money is accounted for, "Jon will be awarded substantial additional funds."

Kate Gosselin confirmed the couple’s joint bank account was down to $1,000, and Jon Gosselin began withdrawing money in August, with the last withdrawal on September 29.

Kate Gosselin also said she took $100,000 out of the bank account in June, and an arbitrator asked her to put the money back.

"We have one parent who is pulling for the best of out children," Kate Gosselin said.

Kate Gosselin also blasted Jon for not wanting to film their TV series.

Jon Gosselin reportedly cleared out the couple's joint bank account, leaving his estranged wife with just $1,000.

A second bank account set up for the Gosselin children, however, was reportedly untouched.
