PHILADELPHIA - The accuracy of breathalyzers has been challenged in court from the very beginning.
Now, hundreds of driving under the influence convictions in Philadelphia may be thrown out because of a breathalyzer that was not properly calibrated.
The test is mandatory. And now the Philadelphia District Attorney's office is offering new trials to people who were found guilty based on those breathalyzer tests from equipment that was not properly set up.
Attornies Danny Cevallos and Richard Hark joined the Fox 29 News at 10 Sunday night to debate whether we need to take a closer look at how we screen for drunk driving? They discussed whether the breathalyzer test should stay mandatory.
