Remember the emergency manager law? 200,000 people signed a petition saying they wanted to vote on it in November. Well, the signatures aren't up for discussion. It's the font size on the petition they're arguing about.
"If, in fact, they can throw this case out, you could never petition our government because it would always be an argument is it 14 points or not," said Al Garret, president of AFSCME Council 25.
Thursday, the Michigan Court of Appeals will decide if the font is correct.
"They have proof, undisputable proof by their own expert that says it is 14 point fonts on the doggone petition," Garret said.
The union boss is claiming foul because the court will not hear testimony from the expert, who the Board of Canvassers consulted, the man who says it is indeed 14 point.
"They won't let it in the record at the Court of Appeals... and it is without a doubt the absolute proof that there should be no court action and it should be on the ballot," Garret explained.
Arguments are scheduled to begin at 10:00 a.m. at the Michigan Appellate Court in Detroit. A protest is scheduled at 9:00 a.m.
