TUCSON, Ariz. (AP) - A mistrial has been was declared in the case of a Tucson woman accused of killing her newborn son by tossing him in the trash.
A Pima County jury deliberated 12 hours over three days before announcing Tuesday that they were deadlocked on the first-degree murder and child abuse counts against Denise Pesqueira.
The jury forewoman also told the judge that they couldn't reach a unanimous decision on the less serious charges of second-degree murder and manslaughter.
The Arizona Daily Star says Deputy Pima County Attorney Anita Simons is expected to announce July 10 if her office intends to re-try the 22-year-old Pesqueira.
Pesqueira was arrested in March 2010 after she allegedly told a friend that she had given birth and put the baby in a trash container.
