Delco Family Battles Borough Over Inflatable Pool

CLIFTON HEIGHTS, Pa. -

"I want my grandchildren to be able to swim in the pool."

Joanne and Fred Mignogna can't believe Clifton Heights Borough Hall code enforcers are actually enforcing a 50-year old ordinance banning inflatable pools like this.

"It sucks, it really does. It's not a swim club it's just a pool for a six year old," says Fred.

The circle print remains in the grass is where their pool used to sit.

"They fined me $375 dollars. I went to court and the judge threw it out but he told me not to put the pool back up," says Fred.

It's a problem they face every summer. In the past, they tried alternatives for their grand kids to keep cool like playing with the hose and a slip-N-slide until their granddaughter got hurt.

There are some homes in the neighborhood with pools. The difference is the borough allows them in backyard but not the front. Fred says that's unfair to them because they don't really have a backyard.

"I offered to put it on the side in the back and they claim that because we are a corner house, our whole yard is a front yard. I think that's ridiculous."

The Mignogna say the only option code enforcers gave them is to put it on the concrete behind their house. They say that's not an option.

Joanne says, "No. My grandchildren aren't going to play in traffic. The trash trucks come through there, there's traffic coming through there all the time."

"We should be allowed to put it in the front. It's not hurting anyone, it's fenced in and we kept it covered," says Fred.

Fox 29 contacted Borough Hall officials. We are waiting to hear back from them.
