Widowed Delco Dad, Sons Told To Leave Home

NETHER PROVIDENCE TWP., Pa. -

David Colletta packed up the last box of his belongings and left his Nether Providence home  after losing a court battle with the township over whether he could live in a modular home on his property while his primary home was repaired after a freak accident.

"I know they want me out and now they got a little bit of a step towards it," Colletta told FOX 29.

A Delaware County judge ordered Colletta and his four sons to leave their temporary home after a court fight. Colletta was told to cease and desist living in either house and to vacate the property immediately. The order told police they could use any and all action appropriate and necessary to remove colletta and his sons if they didn't comply.

"If we didn't get off the property they probably would have come here with a swat team and guns and everything else," Colletta claimed.

As FOX 29 first reported back in May, the widower and his sons moved into the modular home while he battled his insurance company for the money to fix his main house. It was damaged when a tree fell on it.

But the township ordered him out, saying the home was unsafe and the modular home was put up without the proper permits.

"The modular home would be going out of here within nine months to a year," Colletta explained. "The way things are going now, I can see this going 6, 7,8  years."

Colletta insisted Tuesday that he fought this fight so his sons could continue attending the local middle school and high school.

"That's the only reason I live in Wallingford," he said. "They wanted to stay here and they wanted to finish school here. I'm not going to give up and I'm not going to go away."

Six truckloads of the family's belongings are now in storage. Colletta's attorney has filed an appeal. His sons are living with friends and relatives. His living arrangements are up in the air.

In an ironic twist, Colletta got his $6,000 school tax bill Monday. Even though he can't live in his home, he is still obliged to pay it. He jokingly said, "This is America."
