Chester County Makes Arrest In 2011 Fatal Car Accident

WEST CHESTER, Pa. -

Chester County District Attorney Tom Hogan announced Thursday the arrest of a Michigan man for his involvement in a fatal car accident in Lower Oxford Township last year. Hogan called the accident another example of how "alcohol and recklessness" destroys lives.

According to Hogan, 22-year-old Phillip Daniel Tomsic was arrested and charged with Homicide by Vehicle while driving under the influence and other related charges. Tomsic is a student at Lincoln University.

The DA says Tomsic was driving a car on November 11, 2011 after he had been drinking. He allegedly borrowed a vehicle and took two other men to get food in Lower Oxford Township.

The DA says Tomsic lost control of the vehicle and struck a tree, causing the car to burst into flames.

While Tomsic managed to crawl out of the car through a window, one of the other men, Anthony Washington, was killed. The DA says the second passenger, Kadeem Fulmore, was pinned in the burning car, but was rescued. He went onto to lose his right foot and his left leg below the knee.

The DA says Fulmore also suffered a traumatic brain injury.

"An incident like this is every family's nightmare," Hogan said in a statement. "This case should be a warning to every student in Chester County not to drink and drive. You do not want to be the one responsible for killing your friends."

According to the county, Tomsic's blood alcohol content was .089 percent, which is in excess of the legal limit.
