Cops: passenger killed in LIE drunk driving crash

A passenger in a vehicle traveling on the eastbound Long Island Expressway was killed early Wednesday morning when the SUV he was riding in slammed into a median and flipped over, according to police.

The crash happened at about 4:30 a.m. after the 108th Street exit in Rego Park, Queens.

Police say the driver was intoxicated at the time of the deadly collision.

Ricardo Rivas, 39, was charged with vehicular manslaughter, criminally negligent homicide and driving while intoxicated.

Three passengers who were in the back seat of the 2003 Ford Explorer were injured and taken to Elmhurst General Hospital in stable condition, said police.

Carlos Rivas, 27, of Queens suffered severe head trauma before succumbing to his injuries. He was pronounced dead at Booth Memorial Hospital.

It is not clear what the relationship is of the driver and the victim who have the same last name.
