January known as 'divorce month'

Many of us believe a new year means a new beginning -- and for some couples that new beginning is a divorce. More people file divorce papers in January than any other month.

Falling in love and getting married doesn't always end happily ever after. When the marriage ends, it's usually right after Christmas.

"After January 1st my phone's ringing off the hook because they held it together as long as they could, they can't take it anymore," says Kaine Fisher.

Kaine Fisher is a divorce attorney with the Rose Law Group. He's always busy in January.

"Around the holidays you've got money stress, stress about seeing family, about buying presents, about working harder to buy the presents."

Many couples hold it together for the kids through December. In legal circles, January is known as divorce month.

No one wants to split at Christmas. They wait to file until January.

"It's time. They may have been festering over that decision for months and months," says Fisher.

No matter why a couple plans to divorce, Fisher has the same advice for all his clients.

"We go through the divorce planning process, there's a lot of preparing and education for a divorce and knowing a family's finances."

September is usually the second busiest month to file for a divorce -- many couples coming home from their summer vacations.

Fisher says many people wait to file for divorce in January because they have a bonus from work and can use it to hire a divorce attorney.

Another reason for January splits -- if couples wait for the New Year, they can still file a joint tax return for the year before.
