N.J. Lawsuit Claims Subway 'Footlong' Less Than 12 Inches

MARLTON, N.J. -

Two New Jersey men filed a complaint against popular chain Subway on Tuesday, claiming the restaurant has been "deceptive" in advertising its sandwiches as a full foot long.

The men filed a proposed class action complaint in the Superior Courts of New Jersey in Burlington County with the assertion that Subway's "Footlong" sandwich is consistently and significantly less than 12 inches long.

The men's attorney said of the case, "Subway is profiting…potentially millions of dollars at consumers' expense through mass, uniform, widespread misrepresentations about the size of its ‘Footlong.'"

Law firm Shabel & DeNittis announced they will represent the men. The suit brings claims under the Consumer Fraud Act, alleging that Subway is committing a deceptive practice in advertising its sandwiches as longer than they really are.

The suit asks for compensation on behalf of all people who bought "Footlongs" in New Jersey since 2007.
