Cop Taking City To Court Over After-Hours Cell Phone Calls

Should you be compensated for answering work-related calls or emails when you're not as work?

One Chicago police officer says you should, and he's ready to take it to court.

Sgt. Jeffrey Allen is suing the City of Chicago for answering his "required to use" department Blackberry when he's off-duty.

Allen's fighting to get overtime pay for the minutes he used during his own time.

Labor experts say there may be a case to Allen's claim now that technology is running far ahead of the law.

But the city says there are work policies and procedures that allow officers to request overtime.
