Jodi Arias due in court Wednesday for penalty phase

Jodi Arias is back in a Phoenix jail after spending the weekend on suicide watch at another lockup. The penalty phase in her trial begins Wednesday.

Arias will return to court Wednesday as jurors determine whether the death penalty should be an option for sentencing. She could also face life in prison.

A jury convicted her last week of first-degree murder in the 2008 killing of her one-time boyfriend, Travis Alexander.

Right after the verdict was read, she sat down for an exclusive interview with FOX 10's Troy Hayden. She told him she would "much rather die sooner than later... I do not want to spend the rest of my life in one place."

Could that statement sway the jury? A leading criminal defense lawyer in the valley says he thinks prosecutor Juan Martinez will try to use Jodi's words to grant her wish.

"He very well could, in fact that is one of the first things I thought of. This will be one of the things he will produce and show the jury, this is what she is doing out here  and you have to see that to show she doesn't care, and make all kinds of inferences from that interview," says Michael Kimerer.

Arias' defense team will likely counter with testimony from psychologists, Arias' family, and very possibly Arias herself.

If the jury doesn't come to an unanimous vote for death, the judge will sentence Arias to life without parole or life with a chance of parole after 25 years.

On Monday, Arias was moved off suicide watch. Monday night, she tweeted, directing all donations to her web site, where the money goes to her commissary.

She'll be housed at the Estrella Jail until her trial is over.

In an interesting twist, the judge issued a ruling Tuesday afternoon banning Jodi Arias for doing any more interviews. Her interview with FOX 10 will be her last.
