Hearing set in lawsuit against polygamous towns


COLORADO CITY, Ariz. (AP) - The judge overseeing a civil rights lawsuit aimed at polygamous towns on the Arizona-Utah border has scheduled oral arguments on a motion to dismiss damages and civil penalties.

The motion filed by attorneys representing Colorado City and Hildale, Utah, relates to alleged violations of the federal Fair Housing Act.

The U.S. Department of Justice sued the towns last year. One claim has been dismissed. Another contends that the towns denied housing rights to former members of the Fundamentalist Church of Jesus Christ of Latter Day Saints.

The towns' attorneys say the claims for monetary damages and civil penalties are barred by statutes of limitation.

Oral arguments are set for June 5.

Earlier this month, the judge denied requests for a change of venue and to protect some religious information.
