Homeowner Charged For Trash Truck Damage, Fox 29 Getting Results

Fox 29, working to get results for a Philadelphia woman who's about to lose her water service because of an errant trash truck.

Beverly Bryant says she installed security cameras when bicycles were stolen right on the front porch of her Southwest Philly home. But what those cameras captured has her feeling victimized all over again!

It was around 8:30 am on the morning of May 17th, when a City of Philadelphia trash truck emerged from an alleyway onto the 6400 block of Windsor Street.

Only the truck didn't quite make it.

It rumbled up over the curb in front of Beverly Bryant's house, crushing the sidewalk.

"Immediately," exclaimed Beverly, "I was like, unbelievable. Unbelievable!"

She caught up with the driver of the trash truck, whom she says admitted causing the damage.

A supervisor was called and Beverly filled out an incident report. She figured the city would repair the sidewalk and that would be that.

Five days later, this notice arrived from the city water department: she had a defective lateral, the pipe that carries water from the "main" to her home.

What's worse? She had ten days to get the pipe fixed, at her expense, or her water would be shut off!

Beverly could see broken pipe right beneath where the sidewalk was smashed.

"And immediately I think they must not know what actually occurred here. It had to be done when they ran over my curb."

Beverly filed a claim with the city's Office of Risk Management, explaining what happened, and describing the extensive damage to the sidewalk and pipes beneath.

But a Risk Management official told Fox 29's Bruce Gordon that a preliminary investigation showed the pipe damage pre-dated the accident.

Bryant does not have homeowner's insurance, and she also does not have hundreds of dollars lying around. All she can do now is wait. Beverly holds her breath for the Water department to make good on its threat.

She tried the tap today, and she still had water. At least for now.

The water department confirmed to Fox 29 late this afternoon that their investigation showed the sidewalk caved in as it did, because there was a void--pockets of air instead of solid dirt-- beneath it.

They say the void was caused by soil erosion, the result of a pre-existing leak from a broken water pipe.

Beverly is on the hook for repairs.
