SOUTHFIELD, Mich. (WJBK) -

Greg Cipriano is calling the upcoming trial of his nephew, Tucker, and his friend, Mitchell Young, a circus that could and should be avoided with plea deals.

"It's a second assault on this family," he said. "It's unnecessary. You've got two defendants who practically have confessed to their crime."

He is the brother of Bob Cipriano, who was beaten to death with a baseball bat allegedly at the hands of his own son and his friend. The two men, who were allegedly high on K2, are set to go on trial Monday for murdering Bob and nearly killing Tucker's mother, Rose, and brother, Sal, last April.

"They've done so much healing over this past year, and now they're going to get assaulted again," Greg Cipriano said.

At the end of May, Rose Cipriano sent a letter to Oakland County Prosecutor Jessica Cooper asking that plea deals be offered in this case instead of a trial. In lieu of that, all she is asking is that her children not be compelled to testify, and she does not want to testify, either.

"Inflicting pain on a nine-year-old girl is only going to terrorize her again," Greg Cipriano said.

Little Isabella and Sal's twin, Tanner, hid during the attack. For them to have to testify could be devastating said Cipriano. He blames Cooper.

"The only motive that's plain on its face is sensationalism and self-promotion," he said.

Cooper told Fox 2 in a statement, "No victim of violence and horror wants to testify in an open court and recount their experiences. Yet, countless people take the witness stand every day to testify against defendants not only because they are compelled to by court order, but because they want to make sure that no one else suffers as they did. It is also my job as the Oakland County prosecutor to do my best to make sure that no one else suffers at the hands of such individuals in the future."

However, Tucker Cipriano's attorney told Fox 2 that under a plea deal the suspects would spend at least 40 years in prison, and it is what the family, the victims, want.

"There's a constitutional obligation, a prosecutor, to work with the victims, and she has totally ignored that," Greg Cipriano said. "She's left us no alternative but to plead to the public to try and get some influence here."

"She has no heart and even less soul."

"The community's been great, and we hope that same community will reach out to Jessica Cooper by phone, email, fax, whatever they have to do to try and beg and plead that they honor Rose's wishes."

Cipriano, himself an attorney, has been to visit Tucker regularly and said his nephew doesn't want to relive this, either.

"He is completely remorseful. He does not want to inflict any more pain on the family. He will take a plea. He will do whatever it takes to avoid a trial," Greg Cipriano said.
