Victim Hit By Repeat DUI Offender Speaks To FOX 29

PHILADELPHIA -

Kyla Possinger rides a motorcycle. But these days, with help from her father, she gets around on four wheels on her way to the physical therapy at Taylor Hospital that will consume the next three plus months of her life.

"I remember hitting the car. I remember flying over the car and I remember landing flat on my back," the 31-year-old says.

Possinger's Suzuki 650 rammed head-on into the Nissan sports car driven by James John Duggan when witnesses say Duggan pulled out of a MacDade boulevard restaurant without yielding.

Possinger was wearing a helmet with a full-face shield.

"It did exactly what it was supposed to do: It saved my life, saved my head, saved my face," she says.

But the crash left her with a damaged rotator cuff, a fractured arm and shattered wrists, ankle and pelvis.

"I was immediately, violently angry because I knew it was bad," Possinger recalls.

Police say Duggan admitted he'd been drinking all night, stated he was drunk and failed a series of field sobriety tests.

Then, Possinger learned about Duggan's driving history of six prior DUI convictions, a license suspended until 2039 and a March DUI case still pending when these charges were filed.

"I don't get it. I really, really do not get it, and there's no way that he should have been able to have that much of an opportunity. ... I'm not angry about it. I'm flabbergasted," Possinger says.

On the night of the accident, police quoted Duggan as saying he was sorry and that he didn't mean to hurt anyone. But witnesses say he did nothing to help Possinger as she lay injured on the street.

"That's a character flaw. But that's his flaw, not something I need to worry about," Possinger says.

The accident will force Possinger to spend her 32nd birthday, this Thursday, in the hospital. She also will miss her sister's wedding in Antigua this Saturday. She was to have been the maid of honor.

Duggan's bail has been revoked. He'll remain behind bars, at least through a scheduled Aug. 12 preliminary hearing.
