Minuteman accused of pointing gun at MCSO deputy

A member of the Arizona Minuteman border-watch movement is accused of pointed an assault rifle at a Maricopa County sheriff's deputy who he mistook for a drug smuggler.

Authorities said 49-year-old Richard Malley was being held Monday on $10,000 bond on suspicion of aggravated assault. He doesn't have a lawyer yet.

Malley, of Glendale, was scouting for drug runners Saturday night along Interstate 8 near Gila Bend.

Two sheriff's deputies checking mile markers in the area say Malley appeared from the side of the road armed with an AR-15 rifle, a .45 caliber pistol and a fixed-blade knife.

They say Malley raised his rifle up and pointed it at a deputy who identified himself as a law enforcement officer.

Malley says he believed the uniformed deputy was a drug smuggler working for a cartel.

"He's lucky he's still alive and he's lucky my deputy is still alive. It could have been a very serious confrontation in the darkness at 9:30 at night," says Arpaio. "Somebody is gonna get killed one of these days over this situation."
