FBI: Clayton Co. officer tried to stage fake drug arrest

ATLANTA -

Federal authorities have charged a Clayton County police officer with attempting to profit from stolen drugs.  Officer Dwayne Penn was arrested Wednesday, and is now in custody.

Penn made a brief appearance before a federal magistrate judge Thursday.  He heard the charges and learned he would stay in custody until a preliminary hearing is held.

According to the criminal complaint, 24 hours earlier, the officer went to a shopping center parking lot off of Memorial Drive near Interstate 285.  He allegedly planned to stage a fake arrest with a drug dealer and seize cocaine to be sold later.
 
Instead, federal agents arrested the veteran Clayton County officer.

Nine years ago as a rookie officer, Penn was hit by gunfire as he tried to restrain a suspect.  He talked then to FOX 5 about what happened.  He said he was anxious to get back out on the streets after the incident.

Court documents say Penn is currently assigned to the U.S. Marshals Service Southeast Regional Fugitive Task Force.

Authorities say the officer and his alleged drug dealer accomplice believed they would be taking six kilograms of cocaine, which they intended to sell and split the profits.
