What's The Legality Behind Parody Twitter Accounts?

Unofficial celeb twitter accounts, nonsense accounts like the empty chair from the Republican National Convention, are these accounts against the law?

Well the estate of deceased actor James Dean thinks so, and they are now suing Twitter over this exact thing--his unofficial twitter account.

Attorney Heather Hansen explained more on Good Day.

Hansen explains that normal parody accounts are safe, but the James Dean account could be in trouble, because it does not says that it is unofficial. Even though it clearly indicates that it is not affiliated with Dean's estate, it is perhaps making money, and it is using Dean's image and taking the handle that Dean's estate wants to use make some money.

"Your right to personality is a property right. It can pass on to your estate, so the estate is suing because they're making big money off [Dean's] picture, his name[,] T-shirts with his picture, various things, want to continue to be able to do so. They feel as though someone else owning this twitter account is stopping them from doing it," explained Hansen.
