Berks County DA Shares Results Of Road Rage Incident

BERKS COUNTY, Pa. -

An off duty police officer in Berks County has been cleared of any wrong doing in a road rage case where he opened fire.

Fox 29’s Drew Dickman reports.

Investigators say Cesar Moreno became enraged when the Sheetz in Shoemakersville refused him service because he wasn't wearing a shirt.

Berks County DA John Adams says Moreno, who has never had a driver’s license, was also fueled by alcohol as he sped down Route 61 with four others in his car.

"All of the occupants of his vehicle told him to slow down, to stop pull over, you're driving out if control,” said Adams.

Adams says Moreno touched close to 100 miles per hour down the torn up roadway before he started tailgating Ryan Brobst, an off duty part time officer with the Hamburg and Fleetwood police departments.

They say Moreno hit Brobst's car, then sped away.

"Ryan Brobst, the off duty officer calls 9-1-1 and is on the telephone with 9-1-1 for the rest of this incident,” said Adams.

Brobst eventually caught up with Moreno's vehicle at a towing company on Berkley Park Road.

Police say three of the five people in Moreno's vehicle, including Ramon Villa, got out and confronted the cop who was not in full uniform.

"He was knocked to the ground and they were hitting on him while he was down on the ground, defenseless,” Northern Berks Regional Police Chief Scott Eaken.

Northern Berks Regional Police Chief Scott Eaken says Brobst had no choice but to use his personal fire arm and shoot Moreno in the chest.

Moreno survived the shooting, while Brobst walked away with bumps and bruises.

"We believe that the use of force by officer Brobst was justified and this was an unfortunate incident," said Adams.

Brobst's future with the two departments is unclear at this time.

Villa is a behind bars and police expect to arrest Moreno soon.

A third person involved in the scuffle with Brobst has not been charged.
