ANGLETON, Texas – Witnesses took the stand this week in the trial of a father accused of killing a drunk driver who killed his kids in Texas.
Two teens who drove up to the car crash testified in an Angelton court.
The high-schoolers say they were questioned by prosecutors and the defense for hours as they described seeing the children badly injured.
The vehicle the children were riding in with their father, David Barajas, was hit by an intoxicated Jose Banda.
Both witnesses said they never saw defendant David Barajas with a gun.
"Yeah, I just can't really comment on any of that because we're in the middle of the trial," defense attorney Sam Cammack said. "But I thought the boys, I think they testified excellent."
David Barajas' wife, Cindy, said, "You just wish it were just a dream, a nightmare – that you'd wake up and just get over it. But it's a nightmare we have to relive every night."
Barajas allegedly left the scene of the accident, went home to retrieve a gun and returned to the scene of the crime, where he shot and killed Banda.
Barajas faces life in prison, if convicted.
